Article 2: Scope

These terms and conditions apply to all purchases and orders made through the Mini Minuit website. By placing an order, you agree to accept these terms and conditions. Additional conditions of the customer are hereby excluded.
The terms and conditions may be amended at any time and will apply to any order placed after this specific adaptation.

Article 3: Offer

The collection of products at Mini Minuit includes baby and children’s clothing from 0 to 4 years, as well as accessories and toys. This offer is subject to change at any time.

Mini Minuit describes the products offered on the website as complete and accurately as possible. The images used on the website are truthful, but there may occassionally be certain elements in the product image that are purely decorative and therefore not included in the price and the product you order. Depending on lighting and screen settings, colors of certain products may appear differently. Mini Minuit is not liable for errors in the product descriptions.

Products in the collection are available while supplies and stocks last. When an ordered product is no longer in stock, the customer will be personally informed. Mini Minuit is not responsible for consequential damages due to the unavailability of a product.

Mini Minuit is always available to help its customers with questions about the products (including sizing, availability, colours, and shipping). The customer can always contact Mini Minuit by using the online contact form or by sending an email to [email protected].

Article 4: Price

All prices are shown in EURO, including VAT and excluding shipping costs. Shipping costs are paid by the customer and can be found under the heading ‘Shipping & Returns’. If additional costs, such as delivery, freight or postage or any other administrative costs are charged, this will be explicitly stated.

The prices stated at the time of placing an order are the correct prices. In exceptional cases, where a price is incorrectly stated on the Mini Minuit website, Mini Minuit possesses the right to change this particular price and the price of any product at any time. The customer will be personally informed of this and has the right to cancel his/her order in case of disagreement with the price change. If an order with an incorrectly displayed price is canceled, Mini Minuit will refund the full purchase amount.
Mini Minuit has the right to change prices at any time. If a product price falls under a temporary offer, this will be explicitly stated.

Article 5: Payment

Mini Minuit can only accept payment through the payment modules used on our website.

Orders are exclusively sent to the customer when Mini Minuit has received the payment.

Article 7: Retention of title

All delivered products remain the exclusive property of Mini Minuit until full payment has been confirmed. This payment includes the purchase price, shipping costs, and other additional costs.

Article 8: Right of withdrawal

The customer has the right to return the ordered products for 14 (fourteen) calendar days, without stating reasons and without payment of compensation. This period of 14 (fourteen) calendar days starts from the moment the customer or a third party designated by the customer has physically received the products. If the order consists of several products and these are delivered separately, the withdrawal period starts after the day on which the customer or a third party has received the last product delivered.

Article 9: Warranty

Mini Minuit guarantees that the products ordered conform to the customer’s order and meet the general expectations based on the specifications of the product.
If the delivered product does not conform to the order, the customer is entitled to the legal guarantee of the product. In order to claim the statutory warranty period, you must provide Mini Minuit with a proof of purchase.

This warranty period starts from the date of delivery to the first owner and is viable for 2 (two) years. If the delivered product does not comply with the agreement, the customer must inform Mini Minuit of this in writing within 2 (two) months from the moment of discovering a defect in the product. In this case, the customer must store the product securely and in its current condition to make sure an objective inspection by Mini Minuit is possible.

If Mini Minuit conforms the damages after inspection, the customer has the choice between repair or replacement. If the repair or replacement is excessive or impossible, or cannot be carried out within a reasonable amount of time, the customer has the right to a price reduction or the full cancellation of the purchase agreement.
If a defect manifests itself within 6 (six) months after delivery, it is considered to have existed before delivery (and is therefore not a hidden defect), unless Mini Minuit can prove otherwise. After this period of 6 (six) months, the proof of the existence of a defect before delivery is at the customer’s expense.

The following non-exhaustive list is indicative in cases where the stated warranty is not valid: failure to provide proof of purchase, improper use of the product beyond its intended use, failure to comply with the instructions for use, failure to comply with the washing instructions, bad maintenance, normal wear and tear, changes to the products made by the customer, the customer knew the defect or had to be informed about the defect when the purchase agreement was concluded.

Article 10: Intellectual property right

The website, logos, texts, photos, names and all communication of Mini Minuit are protected by intellectual property rights that belong either to Mini Minuit, its suppliers or other entitled parties.
It is prohibited to use and/or make changes to the intellectual property rights as described in this section. For example, drawings, photos, names, texts, logos, color combinations, etc. may not be copied or reproduced without the prior and explicitly written permission of Mini Minuit.

Article 11: Force majeure

In case of force majeure, Mini Minuit is not obliged to fulfill its contractual obligations. In that case, Mini Minuit can either suspend its obligations as long as the force majeure situation lasts, or terminate the agreement definitively. Because of the nature of force majeure, Mini Minuit does not owe any compensation to the customer.

Force majeure includes any circumstance beyond the will and control of Mini Minuit that prevents the fulfillment of its obligations in whole or in part. This includes strikes, fire, business failures, power failures, failures in a (telecommunications) network or connection or communication systems used and/or the website of Mini Minuit being unavailable at any time, non-delivery or late delivery of suppliers or other engaged third parties.

Article 12: Complaints and disputes

Mini Minuit sincerely hopes that its customers are always 100% satisfied. If the customer should nevertheless have a complaint, the customer can contact Mini Minuit at [email protected], mentioning the word ‘complaint’ in the subject of the email. Mini Minuit tries to deal with every complaint within 7 (seven) calendar days.

Belgian law is exclusively applicable to all agreements that Mini Minuit concludes with customers and also to disputes arising from this, irrespective of their place of residence.

The dispute can also be resolved out of court via the Consumer Ombudsman Service of the Federal Government (https://consumentenombudsdienst.be/nl). It is authorized to receive any request for out-of-court settlement of consumer disputes. She will in turn either process the application herself or forward it to a qualified entity.
